Filing in Class 42
Now one of the fastest-growing classes at the USPTO given the volume of AI and SaaS filings, and the natural counterpart to Class 9 — if your product is accessed through a browser with nothing to download, this is very likely the primary class, with Class 9 added only if you also ship a downloadable app or hardware component.
The USPTO charges a base application fee of $350 per class under the current fee schedule (as verified on 2026-07-07) — Class 42 is billed the same as every other class. To keep that base fee, use pre-approved wording from the USPTO’s ID Manual to describe your services rather than a custom description, which triggers a surcharge.
