Filing in Class 9
The single most-filed class in the register, and the one most tech founders get wrong by only filing here — Class 9 covers downloadable software (something a user installs or downloads), while software delivered as a hosted service (a SaaS platform accessed in a browser, with nothing downloaded) is a Class 42 service, not a Class 9 good. Most SaaS companies genuinely need both.
The USPTO charges a base application fee of $350 per class under the current fee schedule (as verified on 2026-07-07) — Class 9 is billed the same as every other class. To keep that base fee, use pre-approved wording from the USPTO’s ID Manual to describe your goods rather than a custom description, which triggers a surcharge.
